These Terms of Use (the "Terms") are a legally binding agreement between you and Ariano Team ("Ariano Team", "we", "us", or "our") governing your access to and use of the Ariano mobile application and related services (collectively, the "App" or "Services").
The App is intended for users aged 17 and older (17+). By using the App, you represent that you are at least 17 years old.
1) The Service
Ariano transforms the way you plan and organize events with intuitive tools and seamless features. Whether you're hosting a casual meetup or coordinating a major event, Ariano is your planning assistant.
Key features may include:
- Creating events with details such as time, location, tags, and contact links.
- Uploading custom cover images to make events visually engaging.
- Calendar views to visualize schedules.
- Conflict detection to help identify overlapping events.
- Streamlined publishing and sharing workflows.
We may add, remove, or change features at any time.
2) Accounts
2.1 Registration — You may need to create an account to use certain features. You agree to provide accurate information (including name/username/email) and keep it updated.
2.2 Account security — You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
2.3 Eligibility — The Services are for users 17+ only.
3) User Content
"User Content" means content you submit to the Services, such as event details, tags, text, images (including cover images), and any content you provide through customer support.
3.1 Ownership — You retain ownership of your User Content.
3.2 License to operate the Services — You grant Ariano Team a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your User Content solely as necessary to operate, improve, and provide the Services, and to comply with legal obligations.
3.3 Your responsibilities — You are responsible for your User Content and represent that you have the rights to submit it. You agree not to submit content that:
- infringes intellectual property or privacy rights;
- is unlawful, harmful, or deceptive;
- contains malware or attempts to interfere with the Services.
3.4 Content removal — We may remove or restrict access to User Content if we reasonably believe it violates these Terms or applicable law, or poses a risk to the Services or others.
4) Optional AI‑Assisted Features (If Available)
The App may offer optional AI-assisted features, such as generating or enhancing text or images related to event content.
- Your choice: You control whether to use these features and whether to submit any text or images for processing.
- Server processing: If used, submitted inputs are processed on Ariano Team's own servers.
- No third-party AI sharing: We do not share AI inputs or outputs with any third parties for AI processing.
- Deletion: AI inputs/outputs are deleted from our servers immediately after processing is completed, except for temporary retention needed to deliver results to you.
- No training/marketing: We do not use your submitted content or AI outputs to train models or for marketing.
5) Privacy
Our Privacy Policy describes how we collect and use information. By using the Services, you acknowledge that your information will be handled as described in our Privacy Policy.
6) Acceptable Use
You agree not to:
- misuse the Services, including attempting to access non-public areas or systems;
- reverse engineer, decompile, or attempt to derive source code, except where prohibited by law;
- interfere with or disrupt the Services;
- use the Services to violate any law or regulation.
7) Third‑Party Services and Links
The Services may allow you to add contact links (e.g., phone number or social profiles) to events for direct communication. Your use of third-party services is governed by their terms and policies, and we are not responsible for third-party services.
8) Fees and Purchases (If Any)
If the App offers paid features, subscriptions, or in-app purchases, additional terms may apply at the time of purchase, including App Store billing rules. All purchases are subject to Apple’s terms where applicable.
9) Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. ARIANO TEAM DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIANO TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; OR (C) ANY OTHER MATTER RELATING TO THE SERVICES.
IN NO EVENT WILL ARIANO TEAM’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID TO ARIANO TEAM FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) USD $10.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11) Indemnification
You agree to defend, indemnify, and hold harmless Ariano Team from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.
12) Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms or if necessary to protect the Services, users, or Ariano Team.
Upon termination, your right to use the Services will stop. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitation of liability, dispute resolution, and indemnity).
13) Governing Law; Dispute Resolution; Arbitration
Governing law: These Terms are governed by the laws of the primary place of business of Ariano Team, without regard to conflict-of-law principles.
Binding arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief to protect its intellectual property or confidential information.
Arbitration will be conducted on an individual basis. Class arbitrations and class actions are not permitted.
14) Changes to These Terms
We may update these Terms from time to time. We will update the "Effective Date" above and, where appropriate, provide additional notice in the App. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
